Terms of Service
These terms are the agreement between you and PCP COLLECTION LLC, a limited liability company registered in New Mexico, United States (“we”, “us”), for the use of Captee at captee.ai and app.captee.ai. By creating an account you accept them.
1. What Captee does
Captee takes a video you upload, transcribes it, and produces a finished vertical video with animated captions. It can also add a written hook, remove silences and filler, and re-frame the shot. You download the result and do what you like with it.
2. Your account
You need an account to use Captee. You must be at least 18 to hold a paid subscription (16 for a free account), give accurate information, and keep access to your account secure. You are responsible for what happens under your account. One account is for one person or business; do not share credentials.
3. Your content stays yours
You own everything you upload and everything Captee produces from it. We claim no ownership of your footage, transcripts, styles or finished videos, and we place no restriction on how you use them, commercially or otherwise.
You grant us only the licence we need to run the service: to store, process, transcribe and render your files so we can give you the result. That licence ends when you delete the content or your account. We do not train AI models on your content. Transcription is performed by a third-party provider listed in our Privacy Policy; their own terms govern how they handle audio submitted to them.
You confirm you have the right to upload what you upload, including any rights in the music, footage or voices it contains.
4. Acceptable use
You may not use Captee to create or process content that is unlawful; that infringes someone else's copyright, trademark or privacy; that depicts sexual content involving minors; that harasses or incites violence against people; or that impersonates a real person in a way designed to deceive. You may not resell access to the service, attempt to circumvent plan limits, or interfere with the infrastructure.
If you break these rules we may suspend or close your account.
5. Plans, billing and the founding rate
- Free. A one-time allowance of exports so you can try the service, which carry a small watermark. No card required. The free allowance does not reset: once it is used, continuing means choosing a paid plan.
- Paid plans are billed through Stripe, monthly or annually in advance, and renew automatically until you cancel. An annual plan is charged once and covers the following twelve months. Prices are shown on our pricing page. Where we are registered to collect sales tax or VAT, it is calculated and shown at checkout before you pay.
- The founding rate. The first 100 members to subscribe get 50% off for their first 12 months. On a monthly plan that is your first twelve payments; on an annual plan it is your first year. After that the subscription renews at the standard price for your plan, and we will email you before it does. If you cancel, the founding rate does not carry over to a new subscription.
- Free trials and complimentary access. We sometimes give an account paid features for a limited period, at no charge and with no card required. It ends on the date shown in your account, and it does not renew or turn into a paid plan on its own. If you subscribe while it is running, billing starts that day, and until the trial ends you keep whichever is better: the plan you bought, or the trial you were given. Paying for a smaller plan never cuts a trial short.
- Cancelling takes effect at the end of your current billing period. You keep access until then. We do not provide refunds for partial periods, except where required by law (see section 6).
- Plan limits. Each paid plan includes a set number of videos per calendar month, and the free allowance is a one-time total rather than a monthly one. Every plan also limits the length of footage you upload and the videos you export. Re-exporting a project you have already counted does not count again, and a failed render never counts.
- We may change our prices. Existing subscribers will be given at least 30 days' notice by email, and a change never affects a period you have already paid for.
6. Right of withdrawal (consumers in the EU and UK)
If you are a consumer resident in the European Union or the United Kingdom, you have a statutory right to withdraw from your subscription within 14 days of purchase. Email hello@captee.ai within those 14 days and we will refund you in full, whether or not you have used the service in the meantime. We will not ask you for a reason.
7. Availability
We work hard to keep Captee running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue parts of the service; if we discontinue something significant, we will give you reasonable notice.
8. Warranties and liability
Captee is provided “as is”. To the fullest extent the law allows, we exclude implied warranties of merchantability and fitness for a particular purpose.
We are not liable for indirect or consequential loss, lost profits, lost revenue, or lost or corrupted content. Our total liability in any 12-month period is limited to the amount you paid us in that period. Nothing here excludes liability that cannot lawfully be excluded, and if you are a consumer, your statutory rights are unaffected.
Keep your own copies. Captee is a production tool, not a backup service. Raw uploads are deleted automatically 30 days after upload.
Any claim relating to the service must be brought within one year of the event giving rise to it, except where the law gives you longer.
9. Copyright complaints
We respect copyright and we expect our users to. If you believe material processed through Captee infringes a copyright you own or control, send a notice to hello@captee.ai with the subject line “DMCA Notice”, including:
- your physical or electronic signature;
- identification of the work you say has been infringed;
- identification of the material in question and enough detail for us to find it;
- your name, address, telephone number and email address;
- a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; and
- a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for them.
We will investigate and, where appropriate, remove the material and may close the account responsible. If you believe material was removed in error you may send a counter-notice to the same address. Our designated agent for copyright notices is PCP COLLECTION LLC, New Mexico, United States, reachable at the email address given in this section.
10. Your responsibility for what you upload
You agree to indemnify and hold harmless PCP COLLECTION LLC and its members, officers and contractors against any claim, demand, loss, liability or reasonable legal cost arising from: content you upload or produce with Captee; your breach of these terms; your infringement of anyone's intellectual property, privacy or publicity rights; or your unlawful use of the service.
We may take over the defence of any such claim at our own expense, and you agree to co-operate with us if we do. This section survives the ending of your account.
11. Resolving disputes
If something goes wrong, email hello@captee.ai first. Most problems are solved in a message or two, and we ask that you give us 30 days to put things right before taking formal steps.
If a dispute cannot be resolved that way, it will be settled in the courts of the State of New Mexico, as set out in section 14. If you are a consumer, nothing in this section takes away your right to bring proceedings in the country where you live, or to use any dispute-resolution scheme available to you there, including the European Commission's online dispute resolution platform.
12. Getting your work out
Your projects and rendered videos stay available for download while your account is open, and clips you save to your b-roll library are kept for as long as your account is open.
Download anything you want to keep before you close your account. Closing it deletes your uploads, projects, rendered videos, saved styles and library clips straight away, and they cannot be recovered. If you would like a copy of your content first, email us before you close and we will provide it in a standard format.
Raw uploaded footage is always deleted automatically 30 days after upload, together with the project that used it, whether your account is open or not. Clips you have deliberately saved to your library are not affected by that.
13. Ending the agreement
You can close your account at any time by emailing us at hello@captee.ai, and we will confirm once it is done. We may suspend or close an account that breaches these terms, that is used unlawfully, or where payment fails and is not resolved.
14. Changes to these terms
We may update these terms. For material changes we will email you at least 30 days beforehand. Continuing to use Captee after a change takes effect means you accept it.
15. Governing law
These terms are governed by the laws of the State of New Mexico, United States, and the courts of New Mexico have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring proceedings there.
16. Events outside our control
We are not liable for failure or delay caused by something beyond our reasonable control, including outages at our hosting, storage, payment or AI providers, internet failures, or acts of government. If such an event continues for more than 90 days, either of us may end the agreement without penalty.
17. General
- Assignment. You may not transfer this agreement without our written consent. We may transfer it to a successor if the business is sold, and we may use sub-contractors and service providers to operate Captee.
- Severability. If any part of these terms is found unenforceable, the rest continues to apply.
- No waiver. If we do not enforce something immediately, we have not given up the right to enforce it later.
- Entire agreement. These terms and our Privacy Policy are the whole agreement between us about Captee.
- Notices. Email is a valid way for either of us to give notice, and exchanges by email or through the app count as written proof.
